Local 655 Arbitration Board Minutes, April 4, 2003

Shirley Horn Claim against Al Johnson/Miami Jazz Festival

Meeting called to order at 11:10 am. Present: Graves, Fox, Apana, Ballard, Harp, Luger, Raimondi, Roitstein; absent: Jefferson. The defendant was not present.

President Graves presented the following evidence:

  • An AFM contact was executed in October 2002and duly-signed in November 2002; the contract was not filed with the Local until after the engagement was scheduled to take place

  • The performance was to take place January 10, 2003 at Ransom Everglades

  • The festival was canceled between January 6 and January 9, 2003 and Ms. Horn was informed of the cancellation at that time

  • The festival was notified by Local 655 of its obligation to honor the contract on January 28, 2003 (by certified mail)

  • The festival has not denied that a contract was signed and that the festival was cancelled less than seven days prior to the engagement

  • The festival was sent notice of the Arbitration Board hearing date by certified mail on February 26, 2003

  • The payment to Ms. Horn specified in the contract is $12,000

MSC (by Apana) to find the Miami Jazz Festival guilty of violating the signed AFM contract, and to find them liable for the $12,000 payment specified in the contract.
