Shirley Horn Claim against Al Johnson/Miami Jazz
Festival
Meeting called to order at 11:10 am. Present:
Graves, Fox, Apana, Ballard, Harp, Luger, Raimondi, Roitstein; absent: Jefferson.
The defendant was not present.
President Graves presented the following
evidence:

An AFM contact was executed in October 2002and
duly-signed in November 2002; the
contract was not filed with the Local until after the engagement was scheduled
to take place

The performance was to take place January 10,
2003 at Ransom Everglades

The festival was canceled between January 6 and
January 9, 2003 and Ms. Horn was informed of the cancellation at that time
-
The festival was notified by Local 655 of its
obligation to honor the contract on January 28, 2003 (by certified mail)

The festival has not denied that a contract was
signed and that the festival was cancelled less than seven days prior to the
engagement
-
The festival was sent notice of the Arbitration
Board hearing date by certified mail on February 26, 2003

The payment to Ms. Horn specified in the
contract is $12,000
MSC (by Apana) to find the Miami Jazz Festival
guilty of violating the signed AFM contract, and to find them liable for the
$12,000 payment specified in the contract.
The meeting adjourned at 11:50 am.
