This agreement addresses those questions and concerns, whether you are a duo or a larger group (up to eight).
THE BANDSTAND RECORD AGREEMENT
This Special Agreement was developed for unsigned bands made up of musicians sharing equally in the profits, royalties or any other monies generated by the use of the band’s recordings from albums sold directly from the performance site and local stores.
In addition to the standard contract language, the Bandstand Agreement itemizes the name of the group, titles and length of each song and the date and location of the recording sessions.
This is a free service of documentation and administration provided by the Local for its members. It protects the master tapes from outside entities who may take the opportunity to use the recording(s) without the group’s authorization. The service also provides protection for the members of the group from each other should the group disband.
Equally important…this Agreement allows the AFM to collect on behalf of each musician any additional money that may become due them as a result of any new use of the recording (i.e., recordings to motion pictures, to jingles, etc.).
In the event the masters are picked up for national release (the group is signed with a major label), this Agreement requires the record company to sign the National AFM Phonograph Record Labor Agreement to ensure additional compensation and fringe benefits for the musicians.
